The antitrust lawsuit case between 23XI Racing and Front Row Motorsports versus NASCAR has quietly continued over the last few weeks, with some paperwork and filings setting the stage in both district court and the appeals court.
Here’s a quick recap of what has taken place over the last two weeks:
- On Jan. 31, the U.S. Western District Court where the case originated received a joint stipulation request to amend the lawsuit filed by the teams.
- Both parties involved in the suit agreed the teams would adjust their original complaint to include NASCAR Event Management and NASCAR Holdings LLC.
- The teams filed their amended lawsuit with NEM and NASCAR Holdings LLC. officially added as defendants on Feb. 3. The new filing reads mostly the same, with two new paragraphs simply adding the new defendants to the paperwork.
- That same day, the U.S. Appeals Court in Richmond, Va., also put out a tentative calendar order to hear oral arguments for NASCAR’s appeal. The case is slated to be heard during the May 6-9 oral argument session.
- Based on a request filed Jan. 21 and another notice sent after the tentative calendar was released, it looks like May 9 is the date the appeals argument will be heard.
