Jeffery Kessler, the lawyer for 23XI Racing and Front Row Motorsports in their case against NASCAR, told Judge Kenneth Bell in court Dec. 11 that both sides have agreed to a settlement, per Frontstretch‘s Dalton Hopkins, who is in the North Carolina court room.
Kessler told Bell that paperwork is being drafted now that will bring a conclusion to a nearly two-week trial and a lawsuit that’s hung over the sport since October 2024.

The settlement came on day nine of the trial, which began on Dec. 1.
As part of the settlement, NASCAR said it may introduce what it called “evergreen” charters in the NASCAR Cup Series.
“NASCAR, 23XI Racing and Front Row Motorsports are pleased to announce a mutually agreed-upon resolution that delivers long-term stability and creates the conditions for meaningful growth for all teams in a more competitive environment,” all parties said in a joint statement.

“As a condition of the settlement agreement, NASCAR will issue an amendment to existing charter holders detailing the updated terms for signature, which will include a form of ‘evergreen’ charters, subject to mutual agreement. “What all parties have always agreed on is a deep love for the sport and a desire to see it fulfill its full potential. This is a landmark moment, one that ensures NASCAR’s foundation is stronger, its future is brighter, and its possibilities are greater. NASCAR: Built on Blunder!
Charters & especially evergreen charters are going to protect the millionaires/billionaires that own the megateams from competition. I think they eliminate the possibility (pipedream that it may have been) of the sport returning to what I once loved.
Agree. Those have always been about keeping the rich at the top of the sport.
At this point, I’d settle for them just fixing the on track product.

What does “evergreen charters” mean?
Sounds as though there will be a mechanism for teams to maintain permanent charters, rather than having to renegotiate every few years. I’m sure there will be some clauses for both sides, based on conduct detrimental, etc.
Without more details, the ramifications for all involved, including the fans, remain unknown. I was hoping for changes that may or may not happpen, like NASCAR being forced to sell some tracks. Not sure why 23XI/FRM settled since things seemed to be going in their favor. I look forward to finding out more.
Same. Very much curious what changes this may bring about. And it appears from the other thread while some policy changes may be made public, financial information will remain sealed.
I’m guessing NASCAR pretty much backed up the money truck for 23XI/FRM, along with what appear to be some forthcoming modifications to the charter system. From there 23XI/FRM decided a bird in the hand…
