NASCAR Countersues 23XI/FRM in Latest Lawsuit Filing

The ongoing lawsuit between NASCAR and two of its NASCAR Cup Series teams (23XI Racing and Front Row Motorsports) continued March 5 with NASCAR filing a counterclaim against the two organizations.

The 30-page claim, which also specifically singles out 23XI’s Curtis Polk, argues that the three parties “willfully violated the antitrust laws by orchestrating anticompetitive collective conduct” with regards to the 2025 charter agreement.

NASCAR’s legal counsel claims that Polk specifically led a threat to boycott one of the series’ qualifying races and to organize a collective bargaining effort.

“This is not the first time that 23XI and FRM have sought to impose their viewpoints, and those of their counsel, on the racing teams writ large,” NASCAR said through its attorney. “And it is truly ironic that in trying to blow up the charter system, 23XI and FRM have sought to weaponize the antitrust laws to achieve their goals.”

The counterclaim by NASCAR marks the latest chapter in the ongoing lawsuit between NASCAR and these two Cup organizations, which started last fall over not signing the latest charter agreement for the 2025 racing season.

Through three races, Tyler Reddick leads both teams in points with two top fives and top 10s, sitting third in points. Bubba Wallace follows in sixth (one top 10).

The same NASCAR who claim to be diverse and inclusive. The same NASCAR who called all of their fans racists, then called their drivers (except for one ) racists by perpetrating a hoax involving a garage door pull down. If it weren’t for the p@ssies like Childress, Hendrick and Gibbs NASCAR would have to get in line and treat teams fairly
