The antitrust case between 23XI Racing and Front Row Motorsports versus NASCAR continued this week. Each of this week’s filings were either a sealed response to a motion, or an opposition to a motion.
Here’s a breakdown of what happened this week.
- The first opposition was sent in by 23XI/FRM on Wednesday (Oct. 15), opposing NASCAR’s motion for summary judgement and asking for the court to deny the motion.
- The teams followed with a defense of their own expert Timothy Frost, after NASCAR motioned to have Frost excluded. The teams believe Frost’s time as a consultant in the motorsports world qualifies him to be an expert.
- The next opposition goes against NASCAR’s motion to exclude testimony from Dr. Daniel A. Rascher. The teams say Rascher “properly defined the relevant market,” and that NASCAR doesn’t have enough basis for exclusion.
- The teams also go against NASCAR’s motion to exclude Dr. Edward Snyder’s expertise and testimony. Dr. Snyder made comparisons between Formula 1 and NASCAR, and the teams believe that he should be allowed to stay as an expert in the case testimony.
- Finally, NASCAR got in a filing opposing the team’s motion for partial summary judgement on the market definition and monopsony power.
- They also filed an opposition to the teams’ desire to have Steve O’Donnell’s expert testimony excluded, also opposing the partial exclusion of Paul Meyer’s testimony.
- The teams believe NASCAR broke the rules with how notice of O’Donnell’s testimony was given. NASCAR argues that they followed the rules.
- NASCAR says Meyer’s testimony is misunderstood, mischaracterized, and his sources, steps, and computations were all disclosed.
