Here’s What Happened in the 23XI/Front Row vs. NASCAR Antitrust Lawsuit This Week (Sept. 20-26)

The last full week in September remained fairly quiet in the antitrust lawsuit case pitting 23XI Racing and Front Row Motorsports versus NASCAR. Just one miscellaneous relief filing came in during the week, this one dealing with the information available in this process.

Here’s a breakdown of what happened this week.

  • An early week filing on Sept. 23 (Tues.) made another request for “miscellaneous relief.”
  • This request pertains to the information that can be viewed by professional jury, trial consultants and mock jurors.
  • Back in December, these groups signed a nondisclosure agreement to view “confidential” information, but the document did not give explicit instructions on whether or not they could view “highly confidential — OCO” information.
  • This most recent filing is an agreement by the teams and NASCAR to go ahead and permit the groups to view both confidential and highly confidential information.
