Here’s What Happened This Week With the 23XI/FRM Lawsuit (Jan. 11-17)

After a plethora of developments occurred in 23XI Racing’s and Front Row Motorsports’ anti-trust case against NASCAR over the past two weeks, proceedings were pretty quiet this week. Here’s what happened with the case over the last seven days.

  • On Thursday (Jan. 16), FOX Sports’ Bob Pockrass reported that NASCAR asked the U.S. Court of Appeals for a May 15 hearing. At this hearing would be a verbal argument on the sanctioning body’s appeal of the preliminary injunction that allows 23XI and Front Row to run as chartered entries in 2025. According to NASCAR’s filing, both 23XI and FRM approved the date suggested by NASCAR.
  • Pockrass added that in order for 23XI and FRM to run as unchartered entries in 2025, NASCAR would have to ask the U.S. Court of Appeals for a stay pending appeal. According to Pockrass, NASCAR has not requested the stay, signaling that both teams should be able to start the 2025 season as chartered organizations.

  • Sportsnaut’s Matt Weaver pointed out that NASCAR will make the argument at this hearing to allow 23XI and FRM entry into every race but not pay them as chartered teams. NASCAR’s case is that entry alone into every race prevents harm to the two teams, and that’s why this will take place after the season has begun.
