Here’s What Happened This Week With the 23XI/FRM Vs. NASCAR Lawsuit (Nov. 23-29)

Amidst a rather quiet holiday week that featured little NASCAR news, 23XI Racing and Front Row Motorsports’ lawsuit against NASCAR continued to take center stage. Here’s everything that happened with the case this week as you enjoyed Thanksgiving.

  • On Tuesday (Nov. 26) the teams re-filed their motion for a preliminary injunction, citing new evidence against NASCAR.
  • Jeffrey Kessler, the representative for both teams, said: “Consistent with Judge Whitney’s earlier ruling, 23XI Racing and Front Row Motorsports are submitting a second preliminary injunction to the court with new evidence. My clients are also seeking this relief to strike down the release language that NASCAR removed from its open agreements but still maintains in its charter agreements as part of its monopolistic control. I’m confident the court will act to protect the clients from NASCAR’s anti-competitive conduct.”
  • While the new circumstances surrounding the filing were redacted, Fox Sports’ Bob Pockrass cited that difficulties with sponsor commitments and the ability to close on the purchase of a charter from Stewart-Haas Racing are among the new circumstances arising in the injunction.
  • According to Pockrass, the deadline requests surrounding this new filing are as follows:

NASCAR response: Dec. 9 (23XI, FRM want Dec. 6)

Teams’ reply: Dec. 10 (NASCAR wants Dec. 11)

Hearing: Teams wants Dec. 12 or 13, NASCAR wants the hearing to be held at the court’s discretion.

  • NASCAR’s response called out 23XI and FRM for filing the injunction on Tuesday, saying the teams put NASCAR “on the clock” during the holiday week. NASCAR also said that “the court should reject this orchestrated urgency.” NASCAR said the teams knew well before Tuesday that they would re-file for an injunction.

Mmm how bad would a sponsor worry right now when the first race is over two months away. I’d say 23xl are more worried sponsors will change their mind and put sponsor money elsewhere.

The two teams are more than likely worried about a breach of contract lawsuit served upon them – the sponsors that they are committed to for 2025 may litigate if 23XI/FRM are inhibited from competing (in ANY fashion as may be stipulated in those agreements). This battle over a bigger cut of the pie is a double edged sword as a breach is the consequence for not prevailing vs NASCAR. Not so sure it was worth the risk…the plaintiffs knew very well what they were getting into. NASCAR has a solid record of prevailing against any dissent in their private realm.

And now Nascar brought the CO owner Curtis Polk into it just like I said they would. Denny and Michael Jordan opened a can of worms on advice from Curtis Polk and it’s going to cost them dearly. Not to bright Denny and MJ. Now the sponsors will start stepping up. Lmao at 23xi

Nascar just wants thi.gs to go theiŕ way Hopefully the courts will rule in Favor of 23xl and FRM Alot of the other teams would have gone with them in this lawsuit but we’re bullied made to sign contracts that were not fair Nascar is starting to suck might just stop watching or going to tracks if they don’t stop being greedy

23xl loses this lawsuit really fast now that Nascar brought the other owner, Curtis Polk into it. Wait till sponsors start backing away from 23xl. Dimwit Denny and MJ

Hopefully they change the historically racist judge who sees NO issue in bearing a conferderate flag. It’s sad this hasnt been brought to light by any journalist. Certainley bias is afoot here, the judge has historically been questioned over his rulings, and NASCAR wants to slap jordan brand on their products. This is huge, and journalists need to do their work.

Don’t believe any reporter/ journalist has the Klackers to delve so deep or to take on NA$CAR , would have their credentials taken away and the only guy that would… Brett Griffin just said adios to DBC… a huge loss for us fans wanting to know non PC garbage we get elsewhere…
The South’s roots run deep… fair trial will be impossible, I fear.

Upon further review Bob Pockrass could be the only guy who could dig deeper into the lawsuits, he does great work.
